			<content:encoded><![CDATA[<p>December 1, 2011 – After a break for Thanksgiving, the County Commission was back in business. There were several significant issues on the agenda.</p>
<p>We received the report on the well tests on the mountain to see if there is a local source of water, thereby removing the need to transport water from the valley up to the mountain communities. Good news: there IS a good source of local water! A test well yielded enough water to meet the needs of mountain residents.</p>
<p>Rezoning requests continue to come in from developers who ask the County Commission to take action without holdng a public hearing. This is simply unacceptable. So far, the County Commission is voting to hold public hearings but I remain concerned about the amount of public notice we are providing (less than a week is not acceptable to me).</p>
<p>Finally, the Jefferson County Development Authority is requesting a moratorium on new businesses paying police/fire/emergency services impact fees . This means the costs of providing these services when a new business locates in the county will be shifted to taxpayers. No evidence has been presented to show impact fees are stopping economic growth.</p>

			<content:encoded><![CDATA[<p>November 17, 2011.   Three commissioners voted to keep an item on the agenda even though it had not been properly noticed and violated the open meeting proceedings act as well as the County Commission’s own agenda policy.</p>
<p>Cmr. Frances Morgan and I supported removing it from the agenda. It was a request from Fred Blackmer and Peter Corum to review a zoning application in Shepherdstown. With the support of Commissioner Patsy Noland, the item was placed on the agenda after the close of business on Tuesday. The Open Meetings guidelines require 2 days of notice; this clearly violated state mandates because only one day notice (Wednesday) was given.<br />
The lack of adequate public notice also violated the Commission’s own agenda policy guidelines.</p>
<p>Legal counsel finally advised the Commission not to discuss the topic as it was a violation of the State Ethics Commission 2 business day rule for amendments to the agenda.</p>
<p>The willingness of members of the County Commission to have items placed on the agenda without proper public notice is deeply troubling.</p>

			<content:encoded><![CDATA[<p>(November 10, 2011) The Commission deferred action on changes to allow the expansion of commercial uses without public notice or involvement. This proposal is meant to allow businesses to expand without going through site plan review procedures, which can be expensive. I am not against this concept but the proposal would have allowed some commercial uses to double, triple, even quadruple in size without giving neighbors a chance to comment. Planning staff is going to do some work and come back with another proposal.</p>
<p>I put on an agenda item to require department heads to report to the County Commission on their work projects and to show progress on completing them. The Commission was generally favorable to the idea and the County Administrator will prepare t a policy to require this.</p>

			<content:encoded><![CDATA[<p>November 3, 2011  The County Commission is reviewing changes to the zoning and subdivision ordinances.  I am pleased my proposals to increase citizen notice were approved.  In the name of creating jobs, changes are being proposed to speed up the review process and make some approvals without Planning Board involvement—staff will have the final say.  This philosophy is very troubling. Neighbors, Homeowner Associations (HOA) and citizens in general need to be kept informed and have a voice in planning and subdivision decisions. More changes to the land use regulations are being proposed by the Planning Commission.  I will continue to review them to make sure there are provisions for public notice and participation.</p>

			<content:encoded><![CDATA[<p>October 27, 2011 The Jefferson County Commission budgets about $9.1 million a year to finance emergency services (fire, EMS). It would be a LOT more if we were not fortunate to have volunteer, non-career firefighters in 7 fire companies. Volunteers are getting harder to come by because of the cost of training and the number of people who commute to jobs outside the county who cannot respond to fire calls during the day. Luckily, we have an Emergency Services Agency that looks countywide at fire and EMS needs and costs and distributes the County funds based on a 5 year plan. That is why I was surprised to see a fellow Commissioner had put on the agenda the topic of dissolving the ESA. The idea was dropped as the majority of the County Commission feels differently.</p>
<p>A new fee for emergency services is being discussed just to maintain the current level of service. A public hearing on the proposal , still under discussion, is tentatively planned for January.</p>

			<content:encoded><![CDATA[<p>Local developer Herb Jonkers and his partners have left the residents of Sheridan Estates with a roadway in disrepair and lots of broken promises. The County Commission voted to call in the construction bond for Sheridan Estates (located along US 340 ) totaling $972,616. Construction bonds are posted by developers to assure site improvements required as part of the subdivision plan approval are completed. In the case of Sheridan Estates, homeowners have complained of unfinished roads, incomplete landscaping, and road repair issues. The developer has had 8 years to complete the work. The Commission voted unanimously to call in the construction bond and associated letter of credit and to authorize staff to work with the bank to fund the needed repairs. The agreements approved by the Commission includes a ban on issuance of building permits for unoccupied lots.</p>
<p>Unfortunately, in today’s real estate climate, I foresee more of these issues coming before the County Commission.</p>

			<content:encoded><![CDATA[<p>October 6, 2011 &#8211; The County Commission identified issues that need to be discussed in the next three months. Here they are: impact fees ( whether to reduce them or modify how they are calculated and whether there can be discounts for affordable housing), the FY 13 budget (due in March, but it is never too early to begin discussing key budget issues), the Capital Improvement Plan (needed to guide spending of the $7 million in the capital account), court and government space needs (do we need a new judicial center and when?), improving technology and continued discussions of zoning ordinance amendments.</p>
<p>Discussing long term priorities is a good practice and one I hope continues. Receiving the packet less than a week before a Commission meeting sure makes it hard for me to get up to speed on some very complicated issues. Thinking a few months ahead gives Commissioners and the public a “heads up” as to what will be on the agenda in coming months.</p>

			<content:encoded><![CDATA[<p>September 29, 2011 – The Commission received an overview of gambling revenues, a category that includes table games and video lottery. First, table games. Based on revenues from the first quarter of the fiscal year, projected revenue for all of FY12 would be $1.49 million. The budget for table games for the fiscal year adopted by the County Commission is $920,000. So we are running ahead of budget expectations. The opposite is true of video lottery. The budget amount for video lottery revenue for FY 12 is $4.6 million. Based on revenue from the first quarter of FY 12, the projected amount could actually be 6% less or $3.77 million. In other words, even though table games revenue is above expectations, video lottery revenue is below expectations. The result could be overall less money from gambling sources than budgeted.</p>
<p>&nbsp;</p>
<p>The other part of the budget update concerned the capital outlay account (Fund 246). It now stands at over $7 million. That is the good news. The bad news is that there is no adopted budget for how to use this money. This means on a majority vote of the County Commission all or some of this account could be allocated to a project without any involvement of the public. I again stressed the need for a capital improvement plan so that taxpayers would know what this money will be used for and can have a chance to express their opinions on what projects should receive top priority.</p>

			<content:encoded><![CDATA[<p>September 22, 2011 – I missed the County Commission meeting because I was attending a planning conference sponsored by the WV Department of Transportation. Lots of interesting studies and programs going on at the state, including a state-wide bicycle plan. The funding for highways construction and maintenance looks bleak. The state could lose $143 million under some of the federal funding bills being discussed at the federal level.</p>

			<content:encoded><![CDATA[<p>September 15, 2011 &#8211; Once again, the Water Advisory Committee came under attack. A volunteer, unpaid group of residents with expertise in various aspects of water quality, the WAC is appointed by the County Commission. The group provide s advice on different topics related to water. Commissioner Pellish wants to decommission the WAC because they are too “activist”. The WAC has received grants in excess of $85,000 for stream quality monitoring, sponsored a free hazardous waste program for residents and is placing signs educating residents about watersheds. I support the WAC and am pleased three commissioners (myself, Cmr. Morgan and Cmr. Manuel) voted to continue this important advisory group.</p>
<p>The Commission also voted to lease space for the Prosecuting Attorney on a year by year basis. I voted in support of leasing (NOT BUYING) additional space while we figure out what additional space is needed for judicial offices and county operations. The public must be involved in these decisions as it will require tax dollars</p>
